PIERRE, SD (KELO.com) — A proposed constitutional amendment on eminent domain has cleared a hurdle in the South Dakota Senate. Representative Liz May of Kyle says, if voters approve, it would draw a firm line on the issue, forbidding the use of eminent domain for private economic development or to create greater tax revenues.
The proposal is an outgrowth of last year’s debate over carbon capture pipelines. Lobbyist Brett Koenecke says it could fuel litigation over constitutional language, and generate legal expenses to defend the policy. If lawmakers approve the resolution, the measure would be placed on the November ballot.
