PIERRE, SD (KELO.com) — Attorney General Marty Jackley is celebrating what he calls a big win for property owners. The Supreme Court ruled in favor of states and property owners on controlling small bodies of water in a dispute dealing with the Clean Water Act. The ruling leaves decisions on those waterways in the hands of local authorities instead of the Federal Government.
Jackley says he’s been in the fight over water rights for most of the ten-plus years he has served as Attorney General. Representative Dusty Johnson also chimed in, say the Biden Administration’s effort to broaden the definition of the Waters of the United States (WOTUS) was so intrusive all nine justices on the U.S. Supreme Court ruled against the E.P.A.
The ruling returns jurisdiction over smaller bodies of water to state and local authorities, which Johnson and Jackley both say is where it should be.
