PIERRE, S.D. (KELO.com) — The South Dakota Supreme Court rules in favor of the City of Sioux Falls in one of the Copper Lounge building collapse lawsuits.
The high court found that the City of Sioux Falls did not owe a special duty to protect the Fodness family in the December 2016 collapse.
The city had granted Hultgren Construction permits to renovate the Copper Lounge and an adjacent building.
The court said that the issuance of a building permit does not make the city potentially liable for negligence.
The decision affirmed the circuit court’s dismissal of the lawsuit.
