SIOUX FALLS, SD (KELO.com) – After being on the City Council agenda four times, a plan to develop a section of land south of 41st Street and west of Ellis Road was sent back to the planning commission after neighbors objected to the placement of the collector road.
The 41Ellis plan was originally on the agenda for the City Council on October 18th with a recommendation for approval from the planning commission. However, the neighboring property owners objected to the plan which would have placed the collector road, Ronsiek Avenue, almost completely on their property which would have forced them to pay 100% of the road costs. They requested that the road be placed on the quarter-mile line on the property line which would split the costs for the road between the property owners.
At the November 2nd City Council meeting, the plan was scheduled for 2nd reading and was postponed at the request of the applicant. When the plan was heard at the November 9th Council meeting, the plan had been redrawn to have Ronsiek Avenue almost entirely on the 41Ellis development. The adjoining property owner again objected to the new plan because they felt it would limit their ability to develop without the shared road. The neighboring owner again requested the road be placed on the property line. The developer informed Council it could take 4 months to redraw the plans.
The City Council was hopeful that by postponing the plan for another week, the two landowners could come to an agreement. However, the plan presented to the City Council on November 16 still showed the Ronsiek Avenue collector road in the 41Ellis. Several representatives of the neighboring owners pointed to the city’s ordinances that suggest the roads should be on the property line.
Councilor Greg Neitzert said he felt it was important to read the ordinance and follow what was the plain language. The Council voted 8-0 to send the plan back to the planning commission with guidance to use the property line for the road construction.
