SIOUX FALLS, S.D. (KELO.com) — Hemp can be grown by the Flandreau Indian Tribe.
So says the United States Department of Agriculture. The Flandreau Santee Sioux
submitted a proposal to the USDA under its U.S. Domestic Hemp Production Program.
The Agriculture Improvement Act of 2018 (the 2018 Farm Bill) directed the USDA to
develop a regulatory oversight program for hemp and it includes provisions for the
USDA to approve hemp production plans submitted by states and Indian tribes.
Although it is illegal to grow hemp in South Dakota, that law does not apply to
sovereign tribal lands.
