SIOUX FALLS, S.D. (KELO.com) — The Sioux Falls City Council gives final approval tonight to an ordinance that allows for a casino to have a private door between separate businesses in the same building.
The vote was 6 to 1.
Councilor Theresa Stehly said it would allow more and more subdividing of casinos so they can have more than ten machines. State law allows a casino to have 10 video lottery machines. But state law also allows for a casino owner to subdivide their building into separate businesses with separate entrances so they can add additional machines.
Stehly said that would then allow a casino owner to divide the building into two, three, or four businesses. A City zoning employee said that is allowable if there is a legal description.
However, Councilor Janet Brekke said the state Supreme Court has made it clear that the state of South Dakota has preempted cities from regulating video lottery.
The private door between businesses would more easily allow casino employees to monitor the separate video lottery businesses.
