FLANDREAU, SD (KELO.com) — The case against the man accused of killing Moody County Chief Deputy Sheriff Ken Prorok is moving forward. Attorney General Marty Jackley is pursuing the death penalty against Joseph Hoek, who’s accused of intentionally running down Deputy Prorok while Hoek was trying to elude police in a high-speed chase. So far, Jackley says the defense has not tried to have Hoek declared unfit to stand trial.
If Hoek is convicted of the charges, the Attorney General intends to pursue the death penalty in the case. In addition to a hearing scheduled for later this month, a pre-trial conference is scheduled for October third, just prior to the October 14th trial date.
