SIOUX FALLS, S.D. (KELO.com) — A Brandon, South Dakota, man has been indicted by a federal grand jury for Attempted Enticement of a Minor Using the Internet. According to court records, Gatlin Wayne Herrera, age 29, was charged by criminal complaint on Thursday. He pled not guilty to the indictment which alleges he used his cell phone to attempt to persuade an undercover law enforcement officer posing as a 15-year-old female to engage in sexual activity.
The maximum penalty upon conviction is up to life in federal prison and/or a $250,000 fine, life years of supervised release, and $100 to the Federal Crime Victims Fund.
