YANKTON, S.D. (WNAX) — South Dakota Attorney General Jason Ravnsborg has been found guilty of two charges in connection with the highway death of Joe Boever near Highmore last September. Ravnsborg won’t face any jail time because the two charges are misdemeanors.
Senator Art Rusch of Vermillion is a former circuit judge and
current Chair of the Judiciary Committee. He said prosecutors would need to prove recklessness, not just negligence, to convict Ravnsborg on a felony charge.
“The prosecutor up there who looked at it all took the easy way out, in my view, and said it was merely negligent,” Rusch said.
Rusch says there have been attempts to change the law to make a negligent death a felony, but “it hasn’t gotten anywhere.”
With talk of possible impeachment by the state House, Rusch and other Senators would sit as jurors to hear the case.
