PIERRE, S.D. (KELO.com) — Lawmakers in Pierre discussed how to best regulate voter-approved marijuana use in the state.
But one thing is clear; they don’t want it used in motor vehicles.
House Bill 1061 would make use of marijuana in a motor vehicle a misdemeanor. The draft legislation covers the use of any part of the marijuana plant as well as any derivative or resin from marijuana.
The bill also amends state law governing the use of cannabis or cannabis products outside motor vehicles.
Under the proposed legislation, the use of medical marijuana inside a correctional facility would still be illegal and the use of cannabis products is added to the existing statute. The current law only speaks to ‘cannabis’ but does not address other products as being prohibited.
South Dakota voters approved both medical and recreational marijuana usage in November.
House Bill 1061 went goes to the House Judiciary Committee Monday morning.
