
SIOUX FALLS, S.D. (KELO.com) — South Dakota Governor Kristi Noem has no comment regarding a state request to drop a lawsuit over recreational marijuana.
Court documents Attorney General Jason Ravnsborg’s Office filed last week ask that the court toss out the lawsuit in its entirety. A request to dismiss is a common opening move in most litigation.
The lawsuit seeks to challenge the result of a November election when South Dakotans approved recreational marijuana in the state. State Highway Patrol Superintendent Rick Miller and Pennington County Sheriff Kevin Thom filed the suit.
But the state’s ‘top cop’ – or at least his office – argues that the case as filed is without merit and the voter decision should stand.
