SIOUX FALLS, S.D. (KELO.com) — The lethal injection of convicted South Dakota killer, Charles Rhines, is back on track for the week of November 3.
A judge with the Second Judicial Circuit in Sioux Falls has dismissed Rhine’s latest challenges.
Rhines, of Rapid City, claims that he should have the right to choose the type of drug the state uses to execute him. Judge Jon Sogn disagrees.
Judge Sogn’s full decision is attached to this story in a pdf document.
Rhines brutally murdered a young donut shop employee in Rapid City decades ago.
State Attorney General Jason Ravnsborg says justice for Donnivan Schaeffer is long overdue.
“Rhines has had his day in court. It is now time for him to serve his sentence.”
